SC notice to Centre, RBI over plea on depositing old notes

The Rs10 notes would be the first ones in India which would be printed on plastic instead of paper

A bench led by the chief justice of India J S Khehar asked that why is the government not allowing other categories to deposit notes even when the laws permit to extend the relief.

The judges pointed out that an extension was granted to NRIs and asked why the government and RBI didn't create "a separate category for those who couldn't deposit demonetised notes by December 30".

The Prime Minister's address to the nation on the evening of November 8 past year on demonetisation and subsequent notification of the federal bank that devalued currency notes can be exchanged at RBI offices even up to March 31, 2017 were valid assurances which stood breached by the ordinance, the counsel for petitioner, Sudha Mishra, had said. He also said that such persons would get another chance until March 31 after explaining the difficulty, the Supreme Court observed on Tuesday.

The next hearing on the case will be held on April 11. The Supreme Court wanted to know from Attorney General Mukul Rohatgi, representing the Union of India, that why they had withdrawal the date of March 31 deposit date and issued a notification with an ordinance as a result of which the petitioner had to suffer. The petitioners were also asked to show the documents whether they had gone to banks to deposit the old currency notes or not.

The Ordinance said that only those who were overseas, the armed forces personnel posted in remote areas or others who can give valid reasons for not being able to deposit the cancelled notes at banks can deposit the demonetised currency notes till March 31 at RBI counters. Indians who were overseas between November 9 and December 30 were given a three-month grace period till March 31, 2017 to deposit the junked notes, while for non-resident Indians, the extension was for six months, till June 30.
