India BJP leaders face conspiracy trial in 1992 mosque case

Putting up a courageous face, the Uttar Pradesh unit of the BJP on Wednesday said it has full faith in the judiciary after the apex court allowed a CBI plea seeking trial of top party leaders for criminal conspiracy in the Babri Masjid demolition case.

Of the four party leaders who will now stand trial, Singh is currently the governor of an Indian province, and the constitution protects him from criminal trial. "This case is going on since 1993. Today, no new situation has arisen".

The announcement comes as Advani seeks the official nomination of the BJP for the upcoming presidential elections in July.

Senior advocate K K Venugopal, appearing for Advani and Joshi, had vociferously opposed the proposal for holding joint trial and transferring their case from Raebareli to Lucknow.

The demolition of the mosque marked the culmination of a virulent campaign led by the now ruling Bharatiya Janata Party (BJP).

The bench of Justices PC Ghose and RF Nariman also ruled that the trial judge hearing the Babri case will not be transferred until the judgement in the case is delivered.

However, the apex court has clarified that Kalyan Singh, being Governor of Rajasthan, will not be tried due to constitutional immunity unless he ceases to be in that post.

Addressing a press conference at her residence after the court order, Ms. Bharti rebutted charges of criminal conspiracy in the demolition of the Babri mosque in 1992, saying "a conspiracy would imply that something was done in secret but whatever happened was in full public view". The party further demanded that BJP leader and Union Minister Uma Bharti be sacked from the Cabinet.

Katiyar took a similar line.
