The passenger, David Dao of Elizabethtown, Kentucky, is a 69-year-old doctor who is now undergoing treatment for his injuries, ABC reported.

Dao's attorneys Wednesday filed papers asking the Cook County court to preserve reports and other material related to Sunday's incident.

United Airlines is already dealing with intense public backlash after a doctor was beaten, knocked out, and dragged off one of its plane for refusing to give up a seat he'd paid paid for because United wanted his seat for one of its employees.

As of Tuesday (Wednesday NZT), Dao was still in a Chicago hospital from injuries he sustained when airport security snatched him from his seat aboard United Flight 3411 to Louisville, Kentucky, his lawyer said.

United CEO Oscar Munoz has apologized for the incident and vowed Wednesday that it will never happen again.

Dao is said to be the only passenger of the four asked to leave the flight who did not comply.

When Dao refused to leave the flight because he said he was a doctor who needed to reach his patients, law enforcement officials were brought on board to help remove him. Specifically, he said one policy the airline plans to change is the use of law enforcement personnel to remove passengers from his company's airliners.

Munoz's pledge comes after widespread outrage at a video that showed a forcible removal of a Chicago passenger on Sunday.

The event stemmed from a common air travel issue - a full flight. No one volunteered. United chose to select people at random.

"I think my first reaction to most issues is to get the facts and circumstances".

Passengers were offered a hotel stay and compensation ranging from $400 to $800, in accordance with U.S. Transportation Department rules requiring airlines to compensate passengers who miss flights due to the controversial practice of overbooking.
