'Dreamer' Returned To Mexico Despite Trump Promise

Montes, now in Mexico, lived in the USA since the age of nine and had been protected twice by the DACA status, a program enacted by the Obama administration to protect undocumented immigrants who came to the U.S.as children from deportation.

Fellow Dreamer and United We Dream advocacy director Greisa Martinez told USA TODAY: "We've seen Trump and [Department of Homeland Security Secretary] John Kelly say, 'The DACA program is alive and well.' We've seen [House Speaker] Paul Ryan look straight into the eyes of one of our members and say, 'You have nothing to worry about, '" she said. A statement issued Tuesday says Montes was arrested after "illegally entering the U.S.by climbing the over fence in downtown Calexico".

The DHS says it does have a record, however, of arresting Mr Montes on 19 February after he climbed a border fence to try to get back into the U.S. from Mexico.

Montes told the agent that he'd left his wallet in a friend's vehicle and couldn't produce an ID or proof of his valid DACA status.

President Donald Trump is about to come face-to-face with an old rival from the campaign trail.

At 1 a.m. the night of his arrest, according to the National Immigration Law Center, Montes was deported to Mexicali, Calexico's twin city across the border in Mexico.

Montes had left his wallet in a friend's vehicle so could not show identification or proof of his DACA status and was told by agents he could not go get them, the paper reported. They also note that Montes had been convicted for theft.

He blamed "left-wing activist groups" for filing ethics complaints alleging he mishandled classified information. That raised questions about whether the chairman was too close to the White House to lead an impartial inquiry.

Judge Curiel will be asked to decide whether US Customs and Border Protection should release information on Mr Montes' deportation to his lawyers.

Established in 2012, DACA covers some 750,000 young people brought to the United State as children.

Trump later defended himself in a written statement, saying he did not believe "one's heritage (made) them incapable of being impartial".

"Juan Manuel has been unequivocal in his assertion that he never voluntarily left the country while he had DACA", said attorney Nora Preciado. That's despite assurances from President Donald Trump that the program would be continued, the newspaper said. "We filed a FOIA lawsuit to get answers". His DACA and work authorization were not set to expire until next year, his lawyers said.

Montes was reportedly deported to Mexico hours later, after agents told him he could not retrieve his documents.

The Montes case comes amid growing anxiety among DACA recipients. Trump claimed Curiel could not impartially hear the case because of his background and Trump's hardline immigration policies.

Trump hasn't hesitated to attack other members of the federal judiciary since then, blasting members of the Ninth Circuit Court of Appeals after they struck down his travel ban from Muslim-majority countries as unconstitutional. We know Juan Manuel was physically removed.
