SC questions Centre for making Aadhaar mandatory for PAN cards

After listening the arguments of the both parties, the apex court said that it will look into the constitutional validity of the decision and posted the matter for further hearing on April 25.

The Supreme Court today questioned the Centre's stand that Aadhar card should be made mandatory to file income tax returns.

On March 27, the SC had stated that Aadhaar cards can not be made mandatory by the government for providing benefits of social welfare schemes.

In March, the court had asserted that Aadhaar can not be made mandatory for welfare schemes - as established in previous interim orders.

Attorney General Mukul Rohatgi, who was defending the government's decision in the apex court, told the court that the government had taken the decision under the Uniform Identification Number act.

The AG said that fake PAN cards were being used to divert finds to shell companies to justify the Centre's move to make Aadhaar cards compulsory for PAN cards.

The court in its judgement said, "The Union of India shall give wide publicity in the electronic as well as print media including radio and television networks that it is not compulsory for a citizen to obtain an Aadhaar card".

In a separate ruling last month, the Supreme Court had also said the government can not require citizens to have an Aadhaar card to benefit from government welfare schemes. On October 10, 2015, the government had moved the top court seeking permission to use the ID for a few schemes, but the court had reiterated its stand and said that its use must be "purely voluntary".
