A MA judge on May 9 overturned former New England Patriots star Aaron Hernandez's conviction on charges of murdering an acquaintance in 2013 after his death was ruled a suicide.

As Judge Susan Garsh dismissed the 2013 case because of a MA legal rule, known as "abatement ab initio", many speculated whether Hernandez's fiancée Shayanna Jenkins-Hernandez and daughter would be eligible for compensation from the team and the NFL. He was serving a life sentence without the possibility of parole as he prepared for his appeal. Based on her ruling, Judge Garsh made it clear that, based on MA law, she had no choice but to clear the conviction.

"In our book, he's guilty and he's going to always be guilty", Ward said of Hernandez.

Prosecutors said they would appeal the ruling to the Massachusetts Supreme Judicial Court.

Prosecutors argued that dismissing his murder conviction would reward Hernandez's decision to take his own life.

As Crime Online previously reported, the prison file included notes from interviews with Hernandez's fellow inmates following his suicide.

The 27-year-old Hernandez was also accused of a separate double murder in 2012 and acquitted five days before he killed himself.

Lloyd's family could still proceed with a lawsuit citing a wrongful death against the estate of Hernandez, despite the court's ruling. They said there is no constitutional or statutory right to abatement, and that it's only a practice that has been followed in MA.

However, the Patriots settled a grievance filed by Hernandez in 2014, according to NFL Players Association records.

Hernandez's appellate attorney, John Thompson, told reporters after the hearing that he believes it's still uncertain as to whether Hernandez took his own life. Thompson also said because Hernandez died in prison, it will be hard to definitively determine how he died.

High-profile lawyer Jose Baez, who was Hernandez's lead attorney in his recent double-murder trial in Boston, has promised to do an independent investigation into his death.

MA state law allows for a conviction to be questioned when it is fully appealed due to death.

Hernandez was found hanged in his cell April 19. Hernandez also had put shampoo on the floor to make it slippery, the report states.
