Former Penn State president gets jail time in Paterno scandal

Three former Penn State administrators will go to jail after being sentenced in connection with the Jerry Sandusky scandal.

In a surprise, Spanier - the only one of the three to take his case to trial earlier this year - actually received the lightest sentence: four to 12 months, with the first two in jail and the remainder served under house arrest.

Curley's time behind bars will be the longest - his sentence is seven to 23 months, with three of those in jail. Sandusky was found guilty the next year of sexually abusing 10 boys and is serving a prison sentence of 30 to 60 years while he appeals his conviction.

Two ex-Penn State officials have apologized to the sex abuse victims of Jerry Sandusky while awaiting sentencing for failing to alert authorities to a 2001 allegation against the ex-assistant football coach, allowing the now-convicted serial predator to continue molesting boys for years.

Prosecutors Laura Ditka and Patrick Schulte were seeking up to a year in jail for Spanier, arguing he was the one who ultimately decided not to report assistant coach Mike McQueary's 2001 shower-assault claim to child welfare authorities. After the incident, Spanier and other Penn State officials developed a plan to bar Sandusky from bringing other children to the campus and to inform officials at Sandusky's charity for at-risk children.

The scandal led to the dismissal of head football coach Joe Paterno, who was never charged in the case.

"Spanier was the ultimate decision-maker when it came to reporting Sandusky", prosecutors wrote, adding that "nothing short of a sentence that includes a period of jail time" would be appropriate.

Prosecutors say former Penn State President Graham Spanier was a "failure as a leader when it matter most", when university administrators failed to act on a 2001 sex abuse allegation against ex-assistant football coach Jerry Sandusky.

Since Sandusky's conviction, Penn State has paid more than $90 million to settle civil claims filed by accusers.

It has been a stunning downfall for Spanier, 68, who had spoken publicly about his own history of being abused as a child by his father, who beat him severely.

The 63-year-old Curley and 67-year-old Schultz told the judge Friday they were sorry they didn't do more.

The judge said he was not convinced that Spanier was as culpable as the other two. All three were also fined and sentenced to community service.

"It really sickens me to think I might have played a part in children being hurt". But "why no one made a phone call to police ... is beyond me". Both testified McQueary did not tell them he had witnessed Sandusky molesting a boy.

In a court filing unsealed Thursday, the Pennsylvania attorney general's office also assails two one-time Penn State administrators for their testimony in Spanier's March trial after they pleaded guilty in the case.
