Bill Cosby jury tests patience of judge, defense

On Thursday June 15, 2017 jurors in the controversial Bill Cosby trial announced that they had reached a deadlock after three days (totaling approximately 31 hours) of deliberation.

"Very often, juries that are deadlocked are able to come to a verdict on Friday afternoons or the day before a holiday", says NY criminal defense lawyer Stuart Slotnick, who's been following the trial.

Following six days of testimony and closing arguments, the 12-person jury in Cosby's trial are in their fifth day of deciding whether the famed comedian is guilty of giving drugs to and molesting former Temple University employee Andrea Constand in 2004.

Upon hearing the jurors' requests lead defense lawyer Brian J. McMonagle asked the judge to declare a mistrial.

Jurors started the day asking a seventh question just 30 minutes into deliberation.

Cosby, 79, has been accused by almost 60 women of sexual assault over the past several decades but Andrea Constand, the plaintiff in this case, was the only one still eligible to go to trial.

Jurors asked to rehear Andrea Constand's testimony about phone call records between her and Cosby, said Shari Botwin, a trauma therapist, who was inside the courtroom at the Montgomery County Courthouse.

Judge Steven T. O'Neill then read the definition, which included a doubt that would cause a "reasonable person" to "hesitate before acting on a matter of importance" as well as a doubt that was not "manufactured to avoid the carrying out of an unpleasant duty".

"What is reasonable doubt?" Cosby, 79, pleaded not guilty to the three counts.

On Friday, the judge rejected another motion for a mistrial, this time put forth by Cosby's attorney. Cosby answered the yes-or-no questions emphatically from his defendant's chair. She made the report in her home province of Ontario, Canada.

Cosby has said it was consensual.

District Attorney Kevin Steele, who ran for office promising to pursue Cosby on the long-abandoned case, would then have several months to decide whether to retry Cosby.

Shortly afterward she began feeling dizzy and said her legs were like "jelly", Mason said.

Previously, jurors asked to hear again portions of Andrea Constand's testimony, Cosby's deposition and the testimony of Cheltenham Detective Sgt. Richard Schaffer.

In the testimony, Cosby said that he had given Quaaludes to women he wanted to have sex with and that he never took Quaaludes himself.

According to Constand, on the night of the alleged assault she complained of tension and trouble sleeping while visiting Cosby to discuss her pursuit of a career in sports broadcasting.

"They were here!" said McMonagle, exasperated.

"I was really nervous and wasn't able to recall every particular moment that I had seen Mr. Cosby in order of dates", she explained.

Prosecutors reopened the investigation in July 2015 after Cosby's deposition connected to a 2005 civil suit Constand filed against him was unsealed by a judge. Keshia Knight Pulliam, who played Rudy Huxtable on "The Cosby Show", escorted Cosby into court on the first day of the trial.

The Associated Press does not typically identify people who say they are victims of sexual assault unless they grant permission, which Constand has done.
