At impasse, Bill Cosby jury tests patience of judge, defense

Judge Steven O'Neill said Friday that defense lawyers have made at least four bids for a mistrial as the deliberations have worn on without a verdict.

As the jurors left for the day, O'Neill heaped praise on them, thanking them for their dedication and the sacrifice they've made being 300 miles (482 kilometers) from home in the Pittsburgh area.

Lili Bernard says she was also sexually abused by Cosby. He adds "tonight, just rest".

William Henry Cosby Jr., as his name appears on charging documents, is accused of sexually assaulting Andrea Constand, the former director of women's basketball operations at Temple University, at his Cheltenham mansion in 2004.

Cosby's lawyer said he and Constand were lovers sharing a consensual moment of intimacy.

On Thursday June 15, 2017 jurors in the controversial Bill Cosby trial announced that they had reached a deadlock after three days (totaling approximately 31 hours) of deliberation.

If there is a mistrial, Cosby would not be considered guilty or not guilty, and prosecutors may choose to retry the case with a different set of jurors.

They also asked for clarity around the language of count three, which pertains to whether Cosby administered "drugs, intoxicants or other means for the objective of preventing resistance" without Constand's knowledge, as well as clarification about Constand's testimony about the alleged attack and read-backs of police testimony about Cosby's 2005 interview with police.

He instructed them to rely on their collective recollection.

The jury asked the court to define the phrase "without her knowledge" in the third count of the aggravated indecent assault charge against Cosby.

At a news conference on Thursday, Cosby spokesman Andrew Wyatt urged O'Neill to end the case and send the jurors home.

The man once best known to United States audiences as "America's dad" faces similar accusations from dozens of women, though only Constand's allegations have resulted in criminal charges.

On Friday, the panel listened again to what Cosby had to say about his use of the now-banned party drug quaaludes.

The panel of seven men and five women earlier Friday heard excerpts from an unsealed deposition in which Cosby admitted he kept Quaaludes on hand for sex. When asked if he told Constand what the pills - which the comic referred to as "friends" - were, Cosby answered "No". Prosecutors have suggested he might have given her quaaludes. The jurors also asked the court to define a phrase in one of the charges, to define "reasonable doubt", and to rehear what a detective had testified to about Cosby's interview with police in 2005.

"I have no ability to do anything other than what I've done in this case", O'Neill told Cosby's lawyer, Brian McMonagle.

As for why he called the pills "friends", Cosby said: "Because they might help take some of the stress and tension away". For about 40 hours, the 12 jurors have remained deadlocked on a verdict and this morning they were ordered by the judge to continue trying to reach a verdict.

"There's a misperception that there's a time limit", he said. They've been at it for almost 40 hours since getting the case Monday. It must come to a unanimous decision to convict or acquit.

"If it's a hung jury, it's a hung jury", Majeed said.

The Associated Press does not typically identify people who say they are victims of sexual assault unless they grant permission, which Constand has done.
