Bill Cosby's Fate Now Rests in the Hands of the Jury

The jury at Cosby's trial began deliberating Monday over whether he drugged and molested a woman more than a decade ago in a case

The woman, Andrea Constand, has accused Mr Cosby of drugging and molesting her after a private dinner at his Pennsylvania home. His lawyer has said they were lovers sharing a consensual sexual encounter. She was later fired from the agency and no charges were brought against Cosby.

They'll resume deliberations Tuesday morning. He said Constand has given "one inconsistent statement after another", questioning why she told police at various points in 2005 that she had never been alone with Cosby prior to her alleged assault, that she never contacted him again after and that her assault had happened in March 2004 - all claims she would later revise before her testimony last week.

Cosby's fate now rests in the hands of the jury, as they begin deliberating. I could only see two jurors, but I did catch one of them briefly yawning. Constand's memories were fuzzy and took time to sort out, he said, because she had been drugged. Her mother, Gianna Constand, left midway during McMonagle's closing arguments in which he repeatedly branded her daughter as a liar.

The AP does not typically identify people who say they are victims of sexual assault unless they grant permission, which Constand has done. "For both of them, it's a nightmare every day", the source continued.

The jury got the case late Monday afternoon, on the sixth day of the trial. Cosby says any contact was consensual. He could face up to 10 years in prison if convicted. Schaffer added that police knew of Cosby's vision issues for more than a decade. They began deliberating on Monday afternoon and have been sequestered at a hotel for the trial's duration, a relatively rare occurrence in the USA criminal justice system. Due to statute of limitations, Andrea Constand is the only accuser able to take a criminal case against the 79-year-old entertainer.

He acknowledged that Cosby gave Constand pills, but they were Benadryl and were meant to ease her tension.

And he uses jarring language to describe his sexual encounters with various young women. Constand testified at trial that she did not know who Marguerite Jackson was.

Sworn in briefly outside the presence of the jury, Cosby told O'Neill that he did not intend to testify.

Dozens of women have come forward to say he had drugged and assaulted them.

And Cosby did not testify. Prosecutors and police detectives read aloud portions of Cosby's statements to police in 2005 and in a civil deposition in 2006. He argued that Cosby used his role as a mentor and respected public figure to gain Constand's trust and then drug her and take advantage of her.

During the defense closing argument, Camille Cosby and Constand sat in front rows in the courtroom, only feet apart. But he too raised his voice at times during his more than two-hour closing argument.

ALLYN: Outside the courtroom, Cosby's spokesman, Andrew Wyatt, said those little details undercut the accuser's credibility.

Earlier on Monday, Montgomery County Judge Steven O'Neill asked Cosby if he had had a chance to talk to his lawyers and if he made the decision on whether to testify or to call character witnesses.

Steele said the once-beloved Jello pitchman and "America's Dad" even referred to himself as a "dirty old man".

The prosecution rested its case on Friday after calling 12 witnesses to the stand.

Cosby says his attorneys won't call any character witnesses.

Cosby's wife, Camille, was present for Monday's proceedings, the first time a Cosby family member has attended the trial.

The defense opens it case Monday.

"It requires tremendous concentration and command of the facts, and the ability to synthesize that in real time", Hall said.

She tearfully told a court in Norristown, Pennsylvania, last week how the Hollywood icon molested her after giving her three blue pills at his home in Philadelphia.

Jurors also heard Cosby's version in the form of his police statement and his lurid deposition in her 2005 lawsuit. It was a factual yet dry counterpoint to Brian McMonagle's fire-and-brimstone closing argument for the defense.
