Supreme Court gives Trump more time to file travel ban briefs

U.S. President Donald Trump's executive order temporarily curtailing immigration from six Muslim-majority countries was dealt a new legal blow on Monday when the Ninth Circuit Court of Appeals upheld an injunction blocking its implementation.

Another appeals court, the Richmond, Virginia-based 4th US Circuit Court of Appeals, last month upheld a Maryland judge's ruling that also blocked Trump's ban.

The Trump administration has already sought the high court's review of another appellate court's ruling against the executive order, which called for temporarily suspending the USA refugee program and barring travelers from six majority-Muslim countries.

A United States appeals court on Monday left in place a block on President Donald Trump's travel ban targeting citizens from six Muslim majority nations - the latest in a string of judicial blows for the controversial measure. "We vacate the portions of the injunction that prevent the Government from conducting internal reviews".

The judges added that Trump's order also went against other provisions of the "Immigration and Nationality Act" (INA) 'that prohibit nationality-based discrimination and require the President to follow a specific process when setting the annual cap on the admission of refugees'.

Trump's suspension of the USA refugee program also remains blocked.

The 9th Circuit rebuffed the administration's efforts to reinstate that part of the order as well.

The travel ban, the second of the kind, was blocked on March 15 by U.S. District Judge Derrick Watson in response to a suit by the state of Hawaii. In his March ruling striking down the travel ban, a federal judge in Hawaii also held that the suspension of the refugee program was unconstitutional.

The US 9 Circuit Court of Appeals denied the administration's demand for the travel ban on Monday.

The Supreme Court is getting involved in the travel ban case.

"Although President's Trump's cabinet may think otherwise, today's ruling affirms that judges in Hawaii are more than capable of applying our laws and Constitution to President Trump's risky policies".

Earlier this month, the administration approached the Supreme Court after a defeat in the 4 Circuit Court of Appeals. The Ninth Circuit Court ruled only that Trump had failed to fulfill requirements under immigration laws that govern when the president may stop entry of foreign nationals into the country.

At the Supreme Court, anything is possible if you have five votes - a majority of the court.

As NCRM reported in April, out of the very few (less than 1%) 9th Circuit cases the Supreme Court accepts for review, 79% are overturned.
