Supreme Court gives Hawaii until Tuesday to answer Trump travel ban motion

In that ruling the justices sought to strike a middle ground balancing Mr. Trump's powers versus the rights of a select group of people in the U.S. Justice Department lawyers, though, said if Judge Watson is right, nearly everyone can continue to travel to the U.S. despite the ban.

The Justice Department filed briefs late Friday night with the Supreme Court, which gave travel ban opponents until noon Tuesday to file their own response.

The Trump administration is seeking to close a legal window opened for tens of thousands of refugees to enter the United States, appealing a federal judge's order directly to the Supreme Court.

The decision will permit "grandparents, grandchildren, brothers-in-law, sisters-in-law, aunts, uncles, nieces, nephews, and cousins of persons in the United States" to qualify as close family and should be granted entry into the country as exempts from the travel ban, according to CNN. "Only this Court can definitively settle whether the government's reasonable implementation is consistent with this Court's stay", it said.

He also ruled that potential refugees whose files have been shared with resettlement agencies in the USA are considered to have a "close" relationship and must be admitted, despite the country already having hit the 50,000 cap Mr. Trump imposed on refugees this fiscal year. The Supreme Court's decision last month revived parts of Trump's March 6 executive order banning travelers from Iran, Libya, Somalia, Sudan, Syria and Yemen for 90 days, as well as refugees for 120 days.

Attorney General Jeff Sessions, in a strongly worded statement announcing the appeal on Friday, accused the Hawaii court of having "undermined national security, delayed necessary action, created confusion and violated a proper respect for separation of powers".

The Trump Administration further interpreted the phrase "close familial relationship" to include fiancé (e) s and parents- and children-in-law. Sessions said in a statement that the administration would "reluctantly return directly to the Supreme Court" in a bid to overturn Thursday's decision by a USA district judge in Hawaii, which limited the scope of the administration's temporary ban on refugees and travelers from six Muslim-majority countries.

"By this decision, the district court has improperly substituted its policy preferences for the national security judgments of the Executive branch in a time of grave threats, defying both the lawful prerogatives of the Executive Branch and the directive of the Supreme Court", Sessions said. He, along with the 9th Circuit Court of Appeals, the most liberal and overturned court in the land, were reversed when the Supreme Court reinstated the order last month.

"Grandparents are the epitome of close family members", the judge wrote.
