UC President Sues Trump Administration Over DACA Decision

There are approximately 4,000 undocumented students in the UC system, the university said, many of whom are protected under DACA, in addition to teachers, researchers and health care providers protected under the program.

UC president Janet Napolitano, who helped form the DACA program in 2012, filed the lawsuit in a federal court, alleging that the Trump administration's decision violated the rights of the students who participate in the program, reports KTVU.

The program protected about 800,000 people who were brought to the US illegally as children or came with families who overstayed visas, including hundreds of thousands of college-age students.

The lawsuit also argues that the university will lose "vital members of its community, students and employees" if DACA is ended.

Department of Justice spokesman Devin O'Malley gave the same comment about Napolitano's lawsuit as he did in response to the lawsuit by the states.

The motion advises City Attorney Mike Feuer to either file his own lawsuit or join one planned by the state of California which was announced Wednesday by Atty.

"Neither I, nor the University of California, take the step of suing the federal government lightly, especially not the very agency that I led", Napolitano said in a press release from the UC Office of the President. The suit, prepared pro bono by the San Francisco law firm Covington and Burling, seeks an immediate reversal of Trump's decision.

When asked by a reporter if the state of California would support her action, she referenced a lawsuit filed against the Trump administration by a coalition of blue states, and said, "frankly, I don't know why California is not participating that the other lawsuits that the states have filed". It now includes hundreds of thousands of college-age students.

Attorney General Jeff Sessions has said President Barack Obama's decision to implement DACA was an unconstitutional exercise of his authority. New DACA applications are not being accepted, and renewals for people whose eligibility expires before early March 2018 are only being accepted through October 5.

California is home to some 220,000 DACA recipients, thousands of whom attend and work at UC campuses.

The lawsuit, which technically names the Department of Homeland Security and Secretary Elaine Duke as the defendants, seeks declaratory and injunctive relief - a legal action in which the court would require the administration to stop its repeal of the policy.

On Tuesday, both the UC Regents and UCSD Chancellor Khosla sent out separate statements condemning the elimination of DACA and calling on Congress to pass legislation permanently continuing DACA. "But my main interest is in the lives of these young people".
