Cop Confiscates Hot Dog Vendor's Money For Not Having Permit

Vendor's police citation fuels online funding campaign

Over the weekend, Berkeley alum, Martin Flores was leaving a football game with his family when he stopped to buy some hot dogs for his children, according to a GoFundMe page set up for the vendor known only as Juan. The officer issued a citation, but then proceeded to flip through the vendor's wallet, seizing all of his money.

Flores has also created a GoFundMe page to raise money for Juan.

After taking the money, Aranas, the cop, wrote a ticket to the 34-year-old hot dog vendor - a guy named Juan.

Flores says he doesn't think Aranas was wrong in issuing a citation for the vendor's lack of permit but rather that the officer's enforcement appeared to be selective.

When KTVU-TV contacted UC police, they were told the officer had seized the money as evidence.

Biddy also defended the officer's actions in taking the money, saying the "it is typical to collect any suspected illegal funds and enter them into evidence".

Matias has admitted that he did not have a permit to sell food on campus, but believes the officer went too far by confiscating his cash, which amounted to $60.

UC Berkeley Vice Chancellor Scott Biddy said in a statement that the university has instructed officers to monitor illegal vending outside event venues over concerns about public health and local businesses.

The officer did not confiscate any other items from the vendor, according to the university.

While some on social media have come to Aranas's defense, with one commenting, "I have always seen him acting professionally and I have seen him countless times", many have questioned the legality of his actions.

"I totally recognise that people have to have permits".

"We are aware of the incident", UC Berkeley police Sgt. Nicole Sanchez said Sunday.

Biddy said an investigator will be assigned to look at the "procedural and management issues related to the incident".

"That officer was tasked with enforcing violations of vending without a permit on campus".

Campus police detained three others for vending without a license on the same day. Flores had hoped to raise $10,000 for the vendor to cover his legal and personal losses. That fund has almost $55,000 raised.
