Another hearing set over Cowboys RB Elliott's ban

NEW ORLEANS LA – OCTOBER 29 Jordan Howard

"I had no idea when I came in on Friday that I was going to have the chance to come in".

Ezekiel Elliott's attorneys proposed a reduction of the running back's six-game suspension, but neither the National Football League nor the NFLPA were interested in settling the case, ESPN.com reports. "So every day is worth fighting".

Elliott rushed 27 times for 97 yards and a touchdown on short notice in the Cowboys 28-17 victory over the Kansas City Chiefs last Sunday.

If the motion is granted, Elliott will be eligible to continue playing until the the district court's ruling on the denial of the injunction. Elliott, who was not arrested or charged in the case, maintains his innocence after being accused of assaulting his former girlfriend in Columbus, Ohio.

"We note that the issuance of an administrative stay does not constitute a resolution on the merits", Susan L. Carney, a judge on the 2nd Circuit, wrote in Friday's filing. On Tuesday, Failla denied to issue a stay ahead of Elliott's appeal, which lawyers for the NFL Players Association filed on Wednesday.

The sports news site said that a panel of federal judges will convene next week to hear Elliott's request for an injunction that overturns Judge Katherine Failla's ruling from Monday.

"When we started game planning, we didn't think he would be available to us", Cowboys coach Jason Garrett said.

Elliott missed two days of practice last week after Failla's decision on Monday reinstated suspension that was initially announced August 11.
