But the Trump administration says conditions there have now improved and its nationals can return safely. Should DHS fail to extend TPS for both El Salvador and Honduras, it would subject 260,000 immigrants-who come from two of the three countries that make up what has been referred to as "Central America's triangle of death"-to deportation".

But the Trump administration has repeatedly noted that the program was meant to be temporary, and not a way for people to become long-term legal residents of the United States.

TPS for Honduras and Nicaragua are now set to expire on January 5. "Temporary Protected Status is a program that needs to be defended, and we must fight for it". They also highlighted that termination will create labor dislocations in certain construction, food processing, hospitality, and healthcare industries that have relied on Haitian TPS workers since 2010.

Gov. Charlie Baker, a Republican, last week wrote to Duke urging the US government to find a way to let citizens of Haiti, El Salvador and Honduras who benefited from TPS remain in the country.

Extension of the protected status for Haitians "sends a bad signal that the Trump administration may not really be as interested in enforcing the law as first thought", Kobach said.

In May the Trump administration announced it would extend protections to Haitians who fled to the USA until January 2018, but might shut down the program early in the new year. They argue that it is contrary to American values to force people to return to a country that is risky and unstable.
