Supreme Court Taking Up Sports Betting Case

Christie was speaking after the first full day of hearings into whether a Philadelphia-based 3rd US Circuit Court of Appeals was correct in its August 2016 ruling that a 2014 New Jersey statute permitting sports betting at casinos and racetracks violated PASPA (Professional and Amateur Sports Protection Act 1992). All that's standing in its way: A 25-year-old federal law that bars betting on sports in most states.

It's never smart to bet on the outcome of Supreme Court cases, but if I had to wager on the big federalism case disguised as a dispute over sports books, I'd double-down on New Jersey in its fight against professional sports and the USA government.

Justice Anthony M. Kennedy said the federal law seemed to him like "commandeering".

"If New Jersey were to prevail before the United States Supreme Court, it would open the door not only in New Jersey but potentially for the rest of the country", said Daniel Wallach, a legal expert on sports gambling law.

New Jersey had been battling in court for years with the National Collegiate Athletic Association and the four major pro sports leagues: the NFL, NBA, NHL and Major League Baseball.

"States and tribal sovereign nations have proven to be effective regulators of gaming and today's oral arguments before the Supreme Court moved them one giant step closer to offering a new product that Americans demand". Their lawyers sued in 2012 shortly after Gov. Chris Christie signed into law the measure to authorize sports betting at racetracks and casinos.

Stohr said the justices could rule narrowly and allow betting to go forward in New Jersey or they could strike down the federal law entirely.

Federal judges agreed with the NCAA that the state law could not stand because it violated the federal law.

The newest member of Supreme Court bar discusses the argument. But supporters of New Jersey said Congress stopped short of doing that. Couple of race tracks have gone out of business.

Once again, the NCAA and the pro sports leagues sued and won in federal court.

New Jersey's case hinges on proving that PASPA is a breach of the tenth amendment of the constitution, which prevents Congress from ordering states to take part in a federal scheme. Gaming experts said at least a dozen states would likely authorize wagering on sports, including California, Connecticut, Florida, Illinois, Pennsylvania and NY.
