AG: Raila's swearing-in is high treason, punishable by death

NASA leader Raila Odinga

The leader of the opposition coalition party, the National Super Alliance (Nasa), vowed that he and his followers would never recognise either the president or his government and stated that he would begin a campaign of civil disobedience.

The United States has asked Kenyan opposition leader Raila Odinga to call off his planned swearing-in ceremony on Tuesday next week, Kenya's Daily Nation reported on Wednesday.

He said such an inauguration would be outside the Constitution because Kenya already has a sitting president who took the oath of office on November 28.

The penal code says anyone who tries to form a Government contrary to the Constitution could face charges of sedition.

"Any attempts to swear in any person as president other than the one elected in line with the constitution and in a manner provided for in the law is unlawful, illegal null and void", Muigai told reporters.

The opposition leader had boycotted repeat presidential polls in October after successfully challenging the August election and securing a court order for a re-run which Kenyatta won by over 93 percent.

She appears on the latest cover of the music magazine and has been named the magazine's Woman of the Year . That is so hurtful. "The most "ridiculous" part of that is no one knowing my heart when I say things".

Prof Muigai warned counties that have passed the people's assembly motions, saying it was an alien term to the Constitution because it is neither established within the framework of the County Government's Act or any other legislation.

Such devolved Houses, he said, may be surcharged for misusing taxpayers' money.

In its statement, Washington said its concerned by the recent outbreaks of violence and urged security services that they have a responsibility to show maximum restraint at all times and to protect the right of citizens to assemble.

Lone said Odinga has also always been open to a dialogue as he had sought it before elections to ensure that it would be credibly done, but there was no interest in the dialogue nor in holding an honest election. "Up to today, no single ambassador has condemned the killing of people by police", he said. "Kenyan problems can only be solved by the people of Kenya", said Mr Odinga.

Raila spoke at the City Mortuary as he consoled families of those who died following his return from the USA on November 17 when police sought to forcibly break a procession of his supporters who had gone to welcome him at the airport.
