Top US Attorney in Montana Issues Statement on Medical Marijuana


Last week, U.S. Attorney General Jeff Sessions rescinded an Obama-era memo that discouraged enforcement of federal marijuana restrictions on states where cannabis has been legalized.

Sessions announced Thursday that he was rescinding the Cole Memo, which put boundaries on marijuana-related issues that us attorneys would prosecute. This policy shift will significantly heighten risks for credit unions serving state-authorized marijuana-related businesses or operating in states with legalized cannabis. Clarifying, he added, "As long as individuals are compliant with state laws on medical marijuana, then the Rohrbacher-Farr Amendment to the Budget Act prevents the use of federal funds to prosecute medical marijuana cases, as long as the individuals are in strict compliance with the state's laws".

"The move has divided many within the Republican Party, including miffed Colorado Senator Cory Gardner, who announced that he was willing to hold up Department of Justice (DOJ) nominees until Sessions "[lived] up to the commitment he made to me prior to his confirmation". During the second Bush administration, Republican appointee David Bogden was removed as Nevada's US attorney for unstated reasons.
