CJI Deepak Misra to hear PIL on CBI judge BH Loya's death

Days after four top Supreme Court judges took on the functioning of the Supreme Court and case allocation, a three-judge bench headed by Chief Justice of India Dipak Misra is scheduled to hear Justice BH Loya "sudden" death case.

Earlier, a division bench, headed by Justice Arun Mishra was hearing the petition in the death case of Judge B H Loya, who was presiding over the trial in the alleged fake encounter of Sheikh Sohrabuddin.

Congress sympathiser Tehseen Poonawalla and Maharashtra-based journalist Bandhuraj Sambhaji Lone filed two separate PILs for a fresh probe into Loya's death on December 1, 2014.

Justice Mishra did not give any reason for withdrawing from the case, but it was obviously due to four senior-most rebel judges questioning assignment of such an important case to a junior judge.

They included justices S A Bobde and L Nageswara Rao, who had visited Justice Chelameswar's official residence here a couple of times since the January 12 news conference.The top four judges had gone public with their grievances against the Chief Justice of India, saying "unless the judiciary was preserved, democracy can't be protected in the country". BJP president Amit Shah and senior police officers, who faced charges, were exonerated subsequently. The four judges claimed that other politically sensitive cases too are being assigned to a particular bench.

They had confirmed that their complaints include the case of the death of a CBI judge, BH Loya.

This comes after Justice Arun Mishra recused himself from the case last week. The Bench did not heed and terming it a "serious" matter, directed the Maharashtra Government to produce all records.

The West Bengal has challenged an amendment past year in the Income Tax Act by inserting Section 139AA, which provides, inter alia, that every person who is eligible to obtain AAdhaar Number is required to quote it in the PAN application form and Income Tax Return.

Sources said the CJI, though disappointed and hurt by the presser and what sources close to him described as "unfounded-yet-hyped allegations", has quietly gone about studying the process of allocation of cases in various high courts. The CJI order on Friday asked for listing the matter "as per roster". On Saturday, the case was scheduled to be heard on Monday by a Bench headed by the CJI.
