Families sue Cleveland clinic after malfunction possibly destroyed embryos

A San Francisco fertility clinic says thousands of frozen eggs and embryos may have been damaged after a liquid nitrogen failure in a storage tank.

The March 4 incident at Pacific Fertility Clinic, acknowledged on Sunday by the facility's president, is the second such admission in a matter of days, coming on the heels of a similar malfunction the same weekend at an unrelated clinic in Cleveland.

The eggs and embryos in tank #4 had been in storage for as long as 10 years, though the tank still was in active use, Herbert said.

The law firm Peiffer Rosca Wolf Abdullah Carr & Kane announced Monday that it filed a class action lawsuit against University Hospitals in Cuyahoga County in the name of a Pennsylvania couple who called the fertility clinic last week to begin the implantation process and learned their embryos had been destroyed. The clinic called them back later that evening to tell them their embryos had been destroyed.

"It's heartbreaking. Just heartbreaking", Amber Ash said. "The medical community calls it tissue. I think this problem is far more serious than has been presented so far", said Team LGM attorney Tom Merriman.

More families are suing University Hospitals after eggs and embryos they had stored at the University Hospitals Fertility Clinic were jeopardized.

"As soon as the issue was discovered, our most senior embryologists took immediate action to transfer those tissues from the affected equipment to a new piece of equipment". It's also representing clients involved in the recent fertility clinic case in San Francisco. It has put in place more failsafe measures to prevent a repeat.

A fertility expert says that the almost simultaneous storage failures at two fertility clinics across the country from each other are "beyond stunning" but that it appears to be just a coincidence.

"It's two black swan events happening in the same day", he said".
