"But now, in the wake of PETA's proposed dismissal, Naruto is left without an advocate, his supposed "friend" having abandoned Naruto's substantive claims in what appears to be an effort to prevent the publication of a decision adverse to PETA's institutional interests", the court said.

PETA didn't seem particularly close to Naruto even though it sued Slater as a "next friend" of the monkey, the court noted.

This case dates back to 2011 when British nature photographer was on a shoot in the Tangkoko reserve in Indonesia, and a crested macaque monkey named Naruto got hold of his camera and started snapping pictures of itself.

The court has also ruled Slater is entitled to compensation for his legal feels, with the district court now working out how much he should get.

Jeff Kerr, general counsel for Peta, said the group was reviewing the opinion and had not decided yet whether it would appeal.

The 53-year-old said: 'I was making no money from photography, which is a hard industry to begin with'.

PETA and Mr Slater reached a deal in September outside of court where he agreed to donate 25% of the revenue he receives from the selfie to charities that protect crested macaques.

PETA sued Slater and self-publishing company Blurb in 2015, arguing the monkey owned the copyright to the photos and proposing it administer all proceeds for the benefit of the monkey. But the 9th Circuit still made a decision to rule in the important case.

An appeals court in NY past year rejected a case involving two chimpanzees, saying there was no legal precedent for the animals being considered people, and their cognitive capabilities didn't mean they could be held legally accountable for their actions.

The 9th Circuit's opinion - joined by Judge Eduardo C. Robreno, with Judge N.R. Smith concurring in part - rested on three main points: whether PETA's relationship with Naruto was significant enough to allow the organization to be his next friend, whether animals can legally bring a case in federal court, and whether they have standing under the Copyright Act.

Kerr said Monday the 9th Circuit ruling would not affect the settlement.
