New RICO Suit Against Weinstein Claims Brafman Firm Deceived Accuser

Harvey Weinstein has been charged with rape and criminal sex acts, furthering the first prosecution to arise from a slate of sexual misconduct allegations against the former movie mogul.

The suit, filed in the Southern District of NY, (read it in full from Deadline here) also cites the RICO Act - accusing the defendants, basically, of acting like a "corrupt organization" under the law which is normally used against organized crime.

The lawsuit reportedly names Weinstein, board members from his now-defunct production company and the Miramax film company as defendants.

And, as it was mentioned at the beginning of the article, other women were named in the suit, including Caitlyn Dulany, who claims Harvey assaulted, battered, threatened, and held her in his hotel room during the Cannes Film Festival in 1996.

The lawsuit, first reported by Variety, includes an allegation by one woman that Weinstein raped her in his office when she was there to pitch a business proposal.

Elizabeth Fegan, a partner at Hagens Berman, said "we are working to see a day of justice for the hundreds of women who were exploited for Weinstein´s sexual gratification and silenced by this ring of conspirators". These suits allege Weinstein sexually groped, assaulted, raped or coerced dozens of women in encounters in multiple jurisdictions in the US and overseas.

The Blast has obtained an image from the video tape showing Thompson's mouth agape as Weinstein rubs her arm in the privacy of his office.

Both Brafman and Spiro denies the allegations in a statement to CNN.

Mr Weinstein is now free on $1m (£751,000) bail, and has agreed to wear a Global Positioning System tracker and to surrender his passport.

Vance revealed that an investigation into Weinstein's alleged crimes "remains active and ongoing" and slammed what he described as Weinstein's "recent assault on the integrity of the survivors and the legal process".

He maintains he has never had non-consensual sex with a woman.

Salma Hayek, Gwyneth Paltrow and Angelina Jolie are among more than two dozen actresses who say they were sexually harassed by the producer. A spokesman said Spiro represents Ambra Batillana Gutierrez, who made a complaint about Weinstein in 2015. The Associated Press does not identify alleged victims of sexual assaults unless they come forward publicly.
