Giuliani: Trump couldn't be indicted even if he shot Comey

But he said such a move would surely incite political blowback and lead to impeachment proceedings.

Two confidential letters from President Donald Trump's legal team to special counsel Robert Mueller were leaked to The New York Times.

But in a 20-page memo to Mueller, which was obtained and published by The New York Times on Saturday, Trump's lawyers admitted that Trump himself dictated the statement.

Appearing on ABC's This Week, Trump's lawyer clarified by saying that his client "has no intention of pardoning himself", then added that the US Constitution "doesn't say he can't".

"He probably does", he said. Now the president is, however, constrained both by the Congress's impeachment power and the court's ability to undo indictments or investigations that are unfair. "I think the legally correct answer is, as usual, the opposite of Giuliani's answer". That's a political process and pardons would not prevent it. "It's a hypothetical point", he told host Chuck Todd.

He also said the President's legal team planned to challenge any potential subpoena from the special counsel's office as harassment or as unnecessary because the White House has turned over more than a million documents and several witnesses.

The lawyers contend in their January letter that the Constitution empowers the president to, "if he wished, terminate the inquiry, or even exercise his power to pardon".

Mr Trump has not been shy about using his pardon power. "We're leaning toward not", said Giuliani, per Politico. He is telling the truth.

Those opinions, though, are not the same as a court decision, nor do they rule out a president being forced to testify. Questioned about this frightening assertion, Giuliani first advance the shaky theory that Trump didn't obstruct anything by firing FBI Director James Comey, because he knew the investigation into Russian interference would continue without him.

A related investigation by Giuliani's former US attorney's office is examining the dealings of longtime Trump lawyer Michael Cohen. "They were trying to make a broad argument".

Meanwhile, Trump engaged in jabs at the Justice Department via Twitter on Sunday morning, going so far as to put "Justice" in quotes. In other words, even if the president fired Comey (or Mueller) exclusively to protect himself from criminal liability, it's all perfectly legitimate. Manafort has been charged by Mueller with multiple felonies, including money laundering, conspiracy and bank and tax fraud.

The lawyers also made the broad claim that "every action that the president took [amid the Russian Federation investigation] was taken with full constitutional authority pursuant to Article II of the United States Constitution", and thus, "these actions can not constitute obstruction, whether viewed separately or even as a totality". "Should have told me!"
