Supreme Court rejects Northern Ireland abortion law case

"Watching MPs saying how sad they feel about situation in Northern Ireland but shrugging their duties to act to protect human rights set out in Good Friday agreement makes you wonder if they have even read it and responsibilities it gives United Kingdom parliament".

The president of the UK's highest court has said that she has "little doubt" that Northern Ireland's abortion law inflicts "inhuman or degrading" treatment on some women.

The Supreme Court judges said it would have required the case to have been brought by a woman who was pregnant as a result of sexual crime or who was carrying a foetus with a fatal abnormality.

Northern Ireland's abortion laws prohibit abortion in all circumstances, except if the pregnancy puts the mother's life at risk or if it poses a risk of "serious and permanent damage" to her physical or mental health.

Northern Ireland's Attorney General John Larkin QC had argued against the NIHRC case, saying that the Province's law on abortion was a matter for the "democratic judgment" of the legislature.

But a narrow majority of the seven-strong panel of justices were of "clear opinion" that the current legislation is "incompatible" with Article 8 of the European Convention of Human Rights in cases of fatal fetal abnormality, rape and incest, but not serious fetal abnormality.

"The view from the Supreme Court is clear - politicians can no longer duck our responsibilities to properly analyse and legislate on hard issues".

The BBC's health correspondent in Northern Ireland calls the situation "a freakish set of circumstances".

"A majority concludes that the Northern Ireland Human Rights Commission does not have standing to bring these proceedings".

She added: "It is a matter of fundamental human rights on which, hard though it is, the courts are as well qualified to judge as is the legislature".

An emergency debate on the issue of abortion in Northern Ireland was held in the House of Commons on Tuesday. [It] makes clear there is nowhere left for the government to hide on this issue.

"All eyes are now on the UK Government", Teggart added. Theresa May can no longer sit back and do nothing whilst countless women continue to suffer on her watch. "A failure to act would be a cruel betrayal of women".

The ruling comes just weeks after the Republic of Ireland voted decisively in a referendum to reform the country's strict abortion laws, which had effectively banned all terminations.

The UK Government has resisted calls to step in and legislate amid the ongoing powersharing impasse in Northern Ireland, insisting that any decision on abortion in the region has to be taken by locally elected politicians at Stormont.
