Supreme Court hands Trump predictable win on travel ban

Catholic Church leaders expressed their objection to the travel ban in an amicus brief filed on 30 March by the US Conference of Catholic Bishops, Catholic Charities USA and Catholic Legal Immigration Network. It applies even to people with close relatives in the USA and other strong connections to the country. But the Supreme Court ended its term past year by issuing a middle-ground ruling that allowed the travel ban to take effect, except for foreign visitors who have a close family tie or business affiliation in the United States. The four liberals on the court - justices Ruth Bader Ginsburg, Stephen Breyer, Elena Kagan, and Sonia Sotomayor - cast the dissenting votes.

The September proclamation establishing the ban said waivers could be granted if denying entry would cause "undue hardship", if entry of the person would not pose a threat to the United States, and if entry would be in the national interest.

She likened the case to the discredited Korematsu V. USA decision that upheld the detention of Japanese-Americans during World War II. Six cases remain to be decided.

The 5-4 ruling, with the court's five conservatives in the majority, ends a fierce fight in the courts over whether the policy represented an unlawful Muslim ban.

Federal judges have blocked the DACA decision, with Judge Nicholas G. Garaufis in Brooklyn citing Trump's "racially charged language" in a ruling that allowed lawsuits over DACA to proceed. On the list of seven countries covered in the ban that was upheld on Tuesday, only Venezuela and North Korea do not have overwhelmingly Muslim populations.

In fact, Sotomayor, the first Latino justice, made a point of reading such past Trump comments as: "Islam hates us".

The administration had pointed to the Chad decision to show that the restrictions were premised only on national security concerns.

Mr Trump's order was challenged on the grounds that he had exceeded his authority and violated the constitution by targeting Muslims.

So here's what the Supreme Court upheld Tuesday: Trump has the authority to impose travel limits on certain countries, most of which are predominantly Muslim.

It pledged to match donations to the International Refugee Assistance Project (IRAP) to support work advocating for systemic change and legal pathways for those affected by the travel ban.

Of those, 4,900 applications were rejected for reasons other than the travel ban, while 1,147 were found eligible for visas based on an exception to the ban.

It also said the Supreme Court should relegate the order "to the dustbin of history, so it will do no further harm". Roberts wrote that presidents have frequently used their power to talk to the nation "to espouse the principles of religious freedom and tolerance on which this Nation was founded".
