India’s supreme court upholds death penalty for 2012 Delhi gang-rape convicts

Indian defence lawyer AP Singh representing men accused of gang raping and murdering a woman in 2012 talks to the media outside India's Supreme Court building in New Delhi

The Supreme Court on Monday upheld the death penalty for three men convicted in the gruesome gang-rape and murder of a young woman in 2012.

March - June 2014: The convicts appeal in the Supreme Court and the death sentences are put on hold until the court takes a decision.

A three-judge bench of the Apex Court, headed by Chief Justice of India Dipak Misra and also comprising Justice Ashok Bhushan and R Bhanumathi will pronounce the verdict in the case. Akshay Kumar Singh, the fourth convict, had not filed a review plea.

While one of her assailants died in jail, another - a juvenile - was tried by a juvenile justice board and released after he served his three-year sentence.

The Saket fast-track court had awarded death penalty for four convicts of the Nirbhaya rape case, which was upheld by the Delhi HC in 2017.

The court said the death-row convicts had failed to point out any "error" in the earlier judgment. His lawyer had claimed that his client was being framed. After nearly two weeks, the victim succumbed to her injuries in a Singapore hospital where she was flown in a last ditch bid to save her life. The incident had triggered a massive anger among the people that led to the government to adopt several laws for the safety of women. Over the next few days, his brother Mukesh Singh, gym instructor Vinay Sharma, fruit seller Pawan Gupta, a helper on the bus Akshay Thakur, and the 17-year-old juvenile, who can not be named, are arrested.

The mother of Nirbhaya - the 23-year-old medical student whose horrific gangrape and torture and tortured in a moving bus in Delhi had appalled and outraged the nation six years ago - today welcomed the Supreme Court order that confirmed that the five men responsible will hang.

On May 5 previous year, the top court had upheld the death penalty to the four convicts. There is no evidence to show that death penalty acts as a deterrent for sexual violence or any other crime. But their "struggle does not end here", she said, referring to the legal steps that remain before the death sentence is carried out. It was later upheld by the high court. "We will be distracted by this death sentence while this enables the state to abdicate its responsibility to protect women".
