NYS moves to kick Charter Communications out of state

Regulators in NY are reneging on their approval of Charter Communications acquisition of Time Warner Cable, alleging the cable provider broke its promise to deliver high-speed broadband to rural customers.

New York's utility regulators have moved to revoke Charter Communication's ability to operate in the state. The Commission also requires $3 million in penalties from the company.

Charter has 30 days to contest the order, and the company said it plans to fight the decision. Nationwide, Charter has 26 million customers, and the company would continue to own former Time Warner Cable systems in states besides NY.

The cable company, which was formed when Charter and Time Warner Cable merged in 2016, hadn't extended service to 145,000 homes and businesses in the state that are in unserved or underserved areas in NY, according to a ruling from the state's Public Service Commission.

Charter says it remains focused on expanding broadband and said "rhetoric often becomes politically charged" in election years.

On Friday, the commission escalated that battle by revoking its approval of the 2016 Charter-Time Warner Cable merger, which would prevent the company from operating in NY and will likely launch a prolonged court battle.

The commission gave the company two months to find a new cable provider to replace its operations.

Charter denies that claim, however, and has said it is ahead of schedule.

To obtain approval in New York, Charter agreed to extend its high-speed broadband network to 145,000 unserved or under-served homes and businesses over four years.

On Friday, the New York State Public Service Commission voted to revoke its approval of the deal, claiming Charter has failed to meet obligations to build its network in rural regions. What is just as bad is that thousands of New Yorkers who are waiting for the broadband access Spectrum keeps advertising it is providing are still stuck with 20th Century technology. "Charter must ensure no interruption in service is experienced by customers, and, in the event that Charter does not do so, the Commission will take further steps, including seeking injunctive relief in Supreme Court in order to protect NY consumers".
