Rosenstein, expecting to be fired, heads to White House

Axios reported on Monday morning that Rod Rosenstein, the embattled Deputy Attorney General, had tendered his resignation to White House Chief of Staff John Kelly.

The DOJ has released a statement saying Rosenstein's comments were sarcastic, while Rosenstein has outright denied the report.

The news comes after the New York Times reported last week that Rosenstein had brought up the 25th Amendment and taping the president, something a Justice Department official said was done in jest.

The dynamic reflects the lingering anxiety among White House officials and establishment Republicans over Kavanaugh's prospects in the Senate, where the allegations have thrown a once-certain confirmation into question.

Secretary of State Mike Pompeo said on Saturday (Sep 23) that U.S. officials should either support President Donald Trump or quit after a report that the Justice Department's Number Two discussed ways to remove Trump over mental incompetence. Rosenstein reportedly told close associates that he would one day be "vindicated" for being ordered to draft the memo justifying Comey's ouster. But let me be clear about this: "Based on my personal dealings with the president, there is no basis to invoke the 25th Amendment". The outlet reported that he did so "anticipation of being fired by President (Donald) Trump". As for Rosenstein's future, Trump says, "We will make a determination". Rosenstein appointed Mueller and oversees his investigation.

As of Sunday, the president said he had not decided what to do about Rosenstein. If he's removed it could be the precursor to Trump maneuvering to put an end to the investigation. The president has consistently criticized his attorney general, Jeff Sessions, for recusing himself from the Russian collusion investigation.
