German Court Orders iPhones Pulled From Stores

A German court had on 20 December found that Apple had infringed Qualcomm patents on power saving technology used in iPhones

USA chipmaker Qualcomm Inc on Thursday said that it has fulfilled the requirements set out by a court in a patent dispute case against Apple Inc to ban the sale of older iPhone models in Germany.

The court issued an order requiring Apple to stop the sale and importation of the devices in question and to recall affected iPhones from resellers in the country. In the aftermath of the ruling, Apple stopped selling the iPhone 7 and iPhone 8 in Apple Stores in Germany.

It also confirmed that it wouldn't sell the iPhone 7 and iPhone 8 at its 15 retail stores in Germany during the appeals process, but noted that the smartphones would still be available through its carriers and third-party retailers in 6,000 German locations.

The German case is Qualcomm's third major effort to secure a ban on Apple's lucrative iPhones over patent infringement allegations after similar moves in the United States and China and is part of a global patent spat between the two companies.

Apple is appealing the decision.

"We are of course disappointed by this verdict and we plan to appeal". As of now, the iPhone 7 and 8, as well as the iPhone 7 Plus and 8 Plus, are no longer for sale at official Apple storefronts, including the German version of Apple.com.

At the heart of the dispute in the German case are chips made by one of Apple's suppliers used in iPhones, with both parties at loggerheads on how the chips actually work, the court said.

The bond was a requirement of the District Court of Munich, on the basis that should Apple appeal and win, damages caused by the sales ban would be covered.

German reseller Gravis said it was still selling the iPhone 7 and 8 models at its stores as well as online.

Qualcomm has frequently claimed Apple has violated its patents, while Apple says Qualcomm is abusing its dominant position in the market and charging extortionate fees.

However, Apple said all of its iPhone models remained on sale in China, following a software update from Apple and pending a further legal ruling there.

Apple had filed a request for the Chinese court to reconsider its decision, but no outcome has been announced.
