Woods sued over bartender's drunk-driving death

Both Tiger Woods and his girlfriend Erica Herman, were named in the lawsuit

The family of Nicholas Immesberger, who died last December, have filed a wrongful death suit naming the restaurant, Woods and his girlfriend, Erica Herman, who is the general manager of the eatery, called The Woods. The lawsuit also claims that bartenders and servers at the restaurant "sent him out to his car" so Immesberger could drive home.

The lawsuit contends that Herman "personally knew Immesberger, specifically recruited him to work at The Woods and was well aware of Immesberger's habitual abuse of alcohol", and that Woods himself "knew Immesberger personally and through information and believe (sic), Herman had discussed Immesberger and his drinking of alcohol with Tiger".

"This is a tragedy because someone who had a problem was not taken care of, and instead, The Woods (restaurant), Tiger and Erica chose to fuel that addiction", Kuvin said. It alleges that the restaurant's workers, managers and owners allowed the 24-twelve months-faded man to force after being over-served alcohol.

Immesberger had an estimated blood alcohol concentration of 0.256 - more than three times the legal limit in Florida - when his 1999 Chevrolet Corvette left Federal Highway and overturned at about 6 p.m. on December 10, 2018.

Immesberger was reportedly drinking at the restaurant for three hours after finishing his shift that day, and then drove himself home in his 1999 Chevrolet Corvette. "It was a bad night, a awful ending".

He also cited a state law that holds the establishment responsible if it "knowingly serves a person habitually addicted to the use of any or all alcoholic beverage".

Police say that Immesberger, who was not wearing a seatbelt, died at the scene of the accident.

The lawsuit says Immesberger was a bartender at The Woods.

Now, his parents are seeking "in excess of" $15,000 in damages due to the alleged emotional and financial harm caused by the death of their son, according to USA Today.

Tuesday, Woods was asked about the case during his pre-PGA Championship news conference.
