Supreme Court allows Trump plan to curb migrants

The Supreme Court on Wednesday allowed the Trump administration to enforce its most ambitious effort yet to unilaterally make it more hard for migrants from Central America and other parts of the world to seek asylum at the U.S. -Mexico border.

The order means, for instance, that migrants from Honduras, Guatemala, and El Salvador can not seek asylum in the USA if they didn't first ask for it in Mexico.

A U.S. district judge had blocked the policy from going into effect nationwide - days after it was unveiled in July - but the Supreme Court chose to reverse the decision in a brief order late in the day.

Among the nine judges on the court, liberal Justices Sonia Sotomayor and Ruth Bader Ginsburg dissented.

Tigar reinstated the injunction Monday evening after opponents of the asylum ban presented the court with new evidence.

The American Civil Liberties Union quickly filed suit a day after the administration issued the rule in July, arguing the policy unlawfully closed the door at the southern border to individuals fleeing persecution. This means almost everyone from Central America, Africa, or anywhere else who went through Mexico to get to the United States can be denied asylum on the spot if they cannot demonstrate they first applied for asylum in Mexico and were denied.

Unveiled in July, the policy was blocked from taking effect by US District Judge Jon Tigar in California nearly right away.

President Trump tweeted that the ruling was a "BIG United States Supreme Court WIN for the Border on Asylum!". The court would then determine whether a stay should remain in effect. "The lives of thousands of families are at stake".

"Lee Gelernt, deputy director of the ACLU's Immigrants' Rights Project, agreed - saying the rule "would eliminate virtually all asylum at the southern border, even at ports of entry, for everyone except Mexicans". Bifurcated asylum rules would force it to "redesign its workshops and templates".

The Republican president's administration issued the rule in an attempt to reduce the surging number of asylum claims primarily by Central American migrants who have crossed the U.S. -Mexico border in large numbers during his presidency.

The Supreme Court in December rebuffed a bid by the administration to implement a separate policy prohibiting asylum for people crossing the U.S. The administration has said that it wants to close the gap between an initial asylum screening that most people pass and a final decision on asylum that most people do not win.
