Gorsuch emerges as possible LGBT ally in Supreme Court arguments

Supporters of the Deferred Action for Childhood Arrivals or DACA chant slogans and holds signs while joining a Labor Day rally in downtown Los Angeles on Sept. 4 2017

Lower courts have blocked Trump from ending the Obama-era program, which has shielded roughly 700,000 people from deportation and provided them with permits to work. Its dynamics on LGBT issues, however, changed following the 2018 retirement of Justice Anthony Kennedy, a conservative who backed gay rights in major cases and wrote the same-sex marriage ruling.

The court is hearing three cases today and all of them are centered around interpreting Title VII, the part of the Civil Rights Act that prohibits employment discrimination on the basis of sex.

Newly appointed Justice Brett Kavanaugh.

Thus, Fuscarino said, New Jersey and other states with such anti-discrimination laws would not be affected by whatever the Supreme Court decides because the state law would still protect workers here. And she urged, "Every single one of you out there can stand up and make a difference".

"(This) might be the most important Supreme Court case that will impact the LGBTQ community", she said.

Cox added that when "our government sanctions discrimination against us, it's giving everyone in the country also permission to discriminate against us".

If the court rules that LGBT+ people are not protected by Title VII, LGBT+ opponents are likely to use the same legal reasoning to attempt to overturn critical protections in housing, healthcare, credit, education, and more. "So everyone should be aware of that and presidential candidates should be talking about that".

In the first case, Chief Justice John Roberts wondered, if the court finds that sexual orientation is covered by civil rights law, whether there should be exemptions for employers with sincerely held religious beliefs.

The justices will first hear appeals in lawsuits filed by Gerald Lynn Bostock, who claims he lost his job working for Clayton County, Georgia, after he began playing in a gay recreational softball league.

Gerald Bostock said he was sacked from his position as a child welfare services coordinator in Clayton County, Ga., not long after he joined a gay softball league. Last year, the Second U.S. Circuit Court of Appeals in NY overturned its prior rulings, determining that "sexual orientation discrimination is a subset of sex discrimination".

Particularly worrying is Trump's contribution to the Supreme Court.

The lawyers for a series of LGBT employees, who say they were fired from their jobs based on their sexual orientation and gender identity, asked the Supreme Court to rule that the law does, in fact, cover sexual orientation in its Title VII ban on employment discrimination based on sex. Transgender employees have likewise won claims after their employers-including the Library of Congress, a fire department, and an auto fix shop, among others-fired or refused to hire them because they did not fit with the employer's views about how men or women should look and act.

Indeed, more than two decades ago, the Supreme Court ruled that even same-sex sexual harassment was illegal under the statute.

The Garden State is often lauded for having some of the nation's strongest laws protecting LGBTQ residents.

The woman complained to Zarda's employer who fired him for being gay. The court recognized that when a lesbian, gay, or bisexual person is treated differently because of discomfort or disapproval that they are attracted to people of the same sex, that's discrimination based on sex.
