Trump ex-adviser Flynn seeks to withdraw guilty plea - court filing

The former national security advisor to the United States president, General Michael Flynn, has asked the court to withdraw his guilty plea, claiming Russiagate prosecutors forced him to lie and make statements they knew were untrue.

Last week's jail recommendation by the Justice Department was a change of course from DOJ's earlier stance where prosecutors said Flynn was entitled to avoid prison time for his cooperation.

Flynn fired his lawyers past year and brought on a new team led by Sidney Powell, a fierce critic of prosecutorial misconduct within the Justice Department.

"The prosecutor seeks to rewrite history and send Mr. Flynn to prison", Flynn's motion reads.

Flynn pleaded guilty to lying to investigators about his contacts with Russia's ambassador to the U.S., The Hill reported, and agreed to cooperate fully with former Special Counsel Robert Mueller's investigation. "This turnaround puts the government in conflict with the plea".

The government revoked its request for leniency after Sullivan rejected Flynn's earlier claims that he had been duped into pleading guilty to lying to Federal Bureau of Investigation agents about his Russian contacts after the 2016 election.

At very least, Flynn's legal attempt Tuesday night could further drag out a case that's taken several twists since Mueller opened it more than two years ago, lining up Flynn as a key witness against the President.

Prosecutors said the statements call into question whether Flynn has truly accepted his guilt.

"The sworn statements of Mr. Flynn and his former counsel belie his new claims of innocence and his new assertions that he was pressured into pleading guilty to making materially false statements to the FBI", Sullivan wrote.

"It is clear that the defendant has not learned his lesson".

"Michael T. Flynn hereby moves to withdraw his plea because of the government's bad faith, vindictiveness, and breach of the plea agreement", defence attorney Sydney Powell wrote. "He endured massive, unnecessary, and frankly counterproductive demands on his time, his family, his scarce resources, and his life".

This withdrawal motion follows General Flynn's unsuccessful motion to dismiss the case on account of government misconduct.

"It's just been one atrocity after another", said Powell, who added that the government's recent sentencing memorandum appeared to be "full of lies and distortions".
