Evers Vos Fitzgerald ‘very comfortable’ without statewide COVID-19 approach

Green County District Attorney Craig Nolen announced he will not enforce a statewide mask-wearing order that goes into effect August 1, calling the emergency order it is based on "unlawful".

But Nolen said in an announcement that he believes Evers' executive order is an unlawful extension of his March 12 emergency declaration related to COVID-19. "The Legislature is empowered to end any emergency declaration issued by a Governor through the simple passage of a joint resolution that doesn't require the Governor's approval", according to Nass.

The order in March "relates explicitly to COVID-19", Nolen wrote, whereas the new order "includes additional recitals, none of which in my legal opinion reach the threshold of establishing authority" for the governor to issue the new order without violating the state law that grants authority for such orders. It was slated to run until September 28, with violators facing a $200 fine.

Evers has held back on this decision, after the conservative-controlled Wisconsin Supreme Court threw out an order in May from the state health secretary that closed most nonessential businesses in an attempt to slow the spread of the virus.

Republican Assembly Speaker Robin Vos said he opposes a statewide mandate, but he indicated that he wouldn't sue to stop it like he did the "safer at home" order. Fitzgerald also said he is gauging the interest of his caucus in reconvening the Legislature and voting down the order.

A state representative is joining other leaders in a call for a special session to block Wisconsin Governor Tony Evers' recently issued mask order.

With mask-wearing soon to be required from one corner of Wisconsin to another, the state's bankers association is reminding residents of some new rules likely to be in place. Democratic state Sen. Chris Larson, of Milwaukee, started a petition for a statewide mandate. Evers' order doesn't preempt local governments from enacting even stricter ordinances.

Wisconsin is seeing new and significant community spread and increase in cases of COVID-19 which requires that we declare a new public health emergency and require face coverings. Wisconsin has the 28th-highest deaths in the country, and the 35th highest per capita at almost 16 deaths per 100,000 people.

The virus, although still heavily concentrated in urban areas, is spreading to more rural counties that had largely avoided the disease.
