WTO finds U.S. tariffs on China breach trading rules

Washington had not justified why the tariffs imposed after a Section 301 investigation against China were a justifiable exception to its obligations

The World Trade Organisation (WTO) yesterday undercut the main justification for US President Donald Trump's trade war against China, saying that American tariffs on Chinese goods violate worldwide rules.

Washington says tariffs it imposed two years ago on more than $200 billion in Chinese goods were justified because China was forcing companies to transfer technology and intellectual property.

The WTO said the U.S. did not provide evidence that its claims of China's unfair technology theft and state aid justified the border taxes. Washington had not then adequately explained why its measures were a justified exception, the panel concluded.

"The United States must be allowed to defend itself against unfair trade practices, and the Trump administration will not let China use the WTO to take advantage of American workers, businesses, farmers, and ranchers", US Trade Representative Robert Lighthizer said in a statement.

"China's retaliatory tariffs were also arguably a violation of WTO rules", he said "Beijing took matters into its own hands by imposing tariffs over its grievances before any WTO rulings were issued".

China's commerce ministry, for its part, said on Tuesday that it hoped the United States would respect the WTO's rulings and take practical actions to maintain the multilateral trading system. "Maybe they did us a big favor".

In a statement on Tuesday, China's Commerce Ministry said it hoped the USA would respect the rulings of the World Trade Organisation (WTO) and take practical action to maintain the multilateral trading system.

The United States could appeal against Tuesday's ruling.

The WTO's ruling clarified that not only do Washington's actions go against the regulations set forth by the global trade body, but that the U.S. had also failed to properly justify the economic measures imposed against Beijing, as required by the WTO charter. However, that would put the case into a legal void, because Washington has already blocked the appointment of judges to the WTO's appellate body, preventing it from convening the minimum number required to hear cases. China also alleged the duties broke a key dispute-settlement rule that requires countries to first seek recourse from the WTO before imposing retaliatory measures against another country.

In its report, the panel stressed that it was "very much aware of the wider context in which the WTO system now operates, which is one reflecting a range of unprecedented global trade tensions".

The panel was created in January previous year to review Trump's decision to hit China with the tariffs in 2018, which marked the beginning of a trade war between the world's two largest economies. Duties of 10% were imposed on some $200 billion worth of goods in September 2018, and were jacked up to 25% eight months later.

The U.S. president has described the WTO as "horrible" and biased towards China, threatening to quit. "U.S. should withdraw and lead the effort to abolish it".
