A spokesperson for Instagram at the time told the Verge that the company does not access users camera in those instances, with no content recorded. According to the report, Facebook accessed the digicam of iPhone customers who weren't energetic on Instagram, though Facebook has dismissed the cost saying that it was brought on by a bug.

The suit accuses Facebook of using people's mobile phone cameras to spy on them. After that, we came to know that Facebook is listening user's audios.

The outages also sparked on the holiday, Social Media Managers Day, which honors them for their skills, effectiveness and patience, but has many users laughing of the irony. Brittany Conditi, an Instagram user filed the lawsuit against Facebook in a Federal court in San Francisco, Bloomberg reported. This was denied by Facebook, which in turn pinned it on a bug in the app that allegedly led to false notifications being received by users.

The complaint alleges that by "obtaining extremely private and intimate personal data on their users, including in the privacy of their own homes", Instagram and Facebook are able to collect "valuable insights and market research".

With the Conditi v. Instagram, LLC case pushing through in courts, Facebook receives significant backlash and issues that pit the company in an unfavorable light.
