ByteDance asks USA court to intervene in forced TikTok sale

The executive order had directed the app's owner Byte Dance to divest Tik Tok within 90 days

TikTok, which has over 100 million U.S. users, denies the allegations. A US security panel had previously set a November 12 deadline for TikTok to finalize an accord, and TikTok has requested a 30-day extension to keep working toward a solution that would avert a full sale of TikTok as required in the order.

Oracle executive vice president Ken Glueck echoed Trump's claims in a statement shared with Forbes in which he said: "Americans will be the majority and ByteDance will have no ownership in TikTok Global", without offering any additional details.

The short-form video app, which has amassed more than 100 million U.S. users, has been targeted by President Trump for national security concerns and has faced Trump's executive order demanding its ban if it doesn't find new owners by the deadline.

Facing the imminent deadline "and without an extension in hand, we have no choice but to file a petition in court to defend our rights", the company said'.

In a statement provided to The Verge, the TikTok team reiterated its commitment to working with the United States authorities to address security concerns and meet the requirements, but it's unable to do so without ongoing cooperation.

Despite finding new owners in Oracle Corp. and Walmart Inc., TikToK now faces uncertainty as Trump's date comes closer.

An intricate deal involving Oracle and Walmart was agreed, in principle, back in September, but the U.S. administration is said to have gone quiet since initially approving the arrangement. The Justice Department did not immediately comment. The Committee on Foreign Investment in the US had set a Thursday deadline for TikTok to sell its USA operations, or risk being shut down. The new company would be responsible for handling data and content moderation for U.S. users, ByteDance said.

ByteDance said in its court filing it plans to file a request "to stay enforcement of the Divestment order only if discussions reach an impasse and the government indicates an intent to take action to enforce the order". ByteDance says the Committee on Foreign Investment in the United States (CFIUS) is giving it the silent treatment despite the fast-approaching deadline.

TikTok said it has offered detailed solutions to the CFIUS in almost two months, but has not received substantive feedback.

The committee has raised security concerns about ByteDance's acquisition of lip-synching app Musical.ly, which has millions of U.S. users. Tomorrow. According to CFIUS, TikTok to "divest any tangible or intangible assets or property, wherever located, used to enable or support ByteDance's operation of the TikTok application in the United States".

ByteDance's lawsuit also referenced Trump's comments at a September campaign rally that the parties to the deal would "pay $5 billion into a fund for education" so that "we can educate people as to the real history of our country".

TikTok already has had some success in court.

The deadline for TikTok's acquisition or ban is November 12.
