
House Democrats, who will be prosecuting the case in the Senate, will submit a pre-trial brief laying out their case against Trump.
Last week 45 out of 50 Republican senators voted in favour of throwing out the impeachment trial from the Senate.
There's a lot of video and audio available to tell that story - much of it produced by the insurrectionists themselves.
A large majority of Republicans in the Senate also recently took this view. It is well documented that Trump did what he is accused of doing.
However, according to (pdf) the nonpartisan Congressional Research Service, a legislative branch agency within Library of Congress, "it appears that most scholars who have closely examined the question have concluded that Congress has authority to extend the impeachment process to officials who are no longer in office".
Mr Trump's team also denied he had fomented violence, saying in their 14-page brief that his remarks to supporters shortly before they stormed the Capitol that Democrats contend incited violence were protected under the US Constitution's First Amendment right to free speech. This is a highly disputed claim but it's really all they've got. Trump was apparently not receptive to this. The strategy reportedly contributed to the split with his original defense team.
Acquittal of the former president is nearly certain as 67 senators are needed to vote in favor of conviction, meaning 17 Republicans would need to cross the political aisle.
Trump wanted to argue there was mass election fraud, but his legal team wanted to focus on the constitutionality of the process, CNN reported.
"This process is completely unconstitutional and it is a very, very risky road to take with respect to the First Amendment, putting at risk any passionate political speaker which is really against everything we believe and in this country", he said during an appearance on "Hannity".
Senate Minority Leader Mitch McConnell voted alongside the GOP senators who oppose the trial on procedural grounds, but he has criticized Trump directly for his conduct, saying at one point that Trump "provoked" the rioters on January 6. However, it is widely agreed one of the main reasons for the impeachment being pursued is that if found guilty, it would likely prevent him from running for office again, and derail any 2024 Presidential bid.

A censure resolution may be seen as a less divisive move to deal with Trump.
But Trump did end up hiring two lawyers to replace the team that left on Saturday.
Trump's lawyers, David Schoen and Bruce Castor, denied that he had incited the riot by disputing the election results or by exhorting his followers to "fight like hell".
Democrats, who now hold a razor-thin majority in the Senate, will have more say over how this trial will be conducted.
Both Schoen and Castor have reputations for theatricality.
Schoen also was set to defend Jeffrey Epstein, the disgraced financier facing charges of trafficking in minors. Schoen describes himself as someone who has represented "reputed mobster figures: alleged head of Russian mafia in this country, Israeli mafia and two Italian bosses".

Kaine added that he's "very anxious about going through this trial and having the punchline at the end of it: Trump acquitted again".
Trump incited the insurrection last month based on his false claims that Biden did not win November's election.
