Fox News sued for $1.6bn over voter fraud claims

NEW YORK NY- FEBRUARY 09 News headlines on the impeachment trial of Donald Trump are displayed outside of the Fox headquarters

A Dominion Voting Systems voting machine is seen in Atlanta in 2019.

The complaint, filed in DE, is the fourth in a series of lawsuits launched by the Denver-based voting company after it became the center of far-reaching false conspiracy theories surrounding its involvement in the 2020 election - fueled largely by right-wing figures close to then-President Donald Trump as part of the effort to overturn the results of the election.

Those claims helped spur on rioters who stormed the US Capitol on January 6 in a violent siege that left five people dead, including a police officer.

Dominion Voting Systems Corp said it filed a $1.6 billion defamation lawsuit against Fox News on Friday, accusing it of trying to boost its ratings by falsely claiming the company rigged the 2020 USA presidential election against Donald Trump.

Fox News was a well-known ally of former President Donald Trump, and many of his supporters were known to be viewers of the network and its various shows.

Dominion has already filed lawsuits against pro-Trump lawyers Rudy Giuliani and Sidney Powell.

Meanwhile, the false claims resulted in harassment for a number of Dominion's employees, including some death threats.

"There are lots of opinions about the integrity of the election, the irregularities of mail-in voting, of election voting machines and voting software", Lou Dobbs, a Fox News host and close ally of Trump, said at the top of a December segment debunking fraud claims about the voting machine company Smartmatic.

Schiller then says, "Look there's - " but doesn't finish his sentence as two gunshots stop his speaking. Without that quick response, we don't know if there would've been more loss of life. "We had to go".

The lawsuit alleges top Fox personalities hosted guests such as Powell to spread lies about Dominion and then repeated and amplified those false claims.

"Dominion paid kickbacks to government officials who used its machines in the 2020 Presidential Election".

"The truth matters. Lies have consequences", the lawsuit states. And the company has suffered "enormous and irreparable economic harm", lawyers said. The day after Smartmatic sued on February 4, Fox canceled the weekday program "Lou Dobbs Tonight". He has sued the Trump campaign, conservative media columnists and conservative media outlets Newsmax and One America News Network. Unlike Dominion, Smartmatic's participation in the 2020 election was restricted to Los Angeles County.

Dominion lawyers said they have not yet filed lawsuits against specific media personalities at Fox News but the door remains open.

"The buck stops with Fox on this", attorney Stephen Shackelford said. With Fox's global platform, an audience of hundreds of millions, and the inevitable and extensive republication and dissemination of the falsehoods through social media, these lies deeply damaged Dominion's once-thriving business.

The suit was filed in DE, where both companies are incorporated, though Fox News is headquartered in NY and Dominion's US operation is based in Denver. This is the first suit Dominion company has filed against a media outlet, the AP noted.

"FOX News Media is proud of our 2020 election coverage, which stands in the highest tradition of American journalism, and will vigorously defend against this baseless lawsuit in court", a Fox spokesperson told Insider in response to the suit.
