U.S. judge denies immediate release of Andrew Brown shooting video

Petitions to release the body camera footage came from a media coalition and Pasquotank County Attorney R. Michael Cox, who filed on behalf of Pasquotank County Sheriff Tommy Wooten II.

Wooten has urged the public to avoid a rush to judgment while the case is under review by the state Bureau of Investigation, which opened an inquiry at the sheriff's request.

"Today, I'm releasing the names of the seven deputies who I placed on administrative leave after this incident".

An official autopsy has yet to be released, though the death certificate had indicated Mr Brown died of a gunshot to the head. The first shots went through the front windshield of Brown's vehicle, attorney Wayne Kendall said, adding that Brown suffered four bullet wounds to his right arm. It listed the manner of death as a homicide, caused by a "penetrating gunshot wound of the head".

Shortly after the news conference, the FBI's Charlotte Field Office announced that it has opened a federal civil rights investigation, saying in a statement it would work with federal prosecutors in the US Department of Justice to "determine whether federal laws were violated".

Brown's death led to six nights of protests in Elizabeth City and came one day after former Minneapolis police officer Derek Chauvin was convicted of murdering George Floyd in a trial that put a spotlight on police violence against Black people.

While one attorney for Brown's family, Wayne Kendall, initially said it was a "partial victory" for the family to view more video, the legal team later issued a statement condemning the decision not to make the video public.

One driver, a middle-aged white man, was seen with a gun on the dashboard of his pickup truck after approaching protesters and complaining about the blockage, according to Reosha Christian, 35, a city resident taking part in the demonstration.

District Attorney Andrew Womble told the judge that video showed Brown's auto made contact with deputies twice as he backed out of the driveway of his home in Elizabeth City, North Carolina, that day, before law enforcement began firing. "We have to try to figure out how to heal as a community", said City Councilman Darius Horton.

"We want them to tell us who the officers are who shot this man".

The protest unfolded hours after a judge ruled body camera and dashcam footage from Brown's death would not be released to the public for at least 30 days.

The city has a population of roughly 18,000, half of which is Black. He said Brown was still able to turn his vehicle away from the deputies before being shot in the lower part of his skull. Another family lawyer, Chantel Cherry-Lassiter, who viewed the video, said Monday that officers opened fire on Brown while he had his hands on the steering wheel of a vehicle.

The release of the independent autopsy comes a day after family members viewed a portion of police body camera footage of the incident.

Mr Cox did not respond to a request for comment. A North Carolina law that took effect in 2016 allows law enforcement agencies to show body camera video privately to a victim's family, but it generally requires a court to approve any public release. At Wednesday's hearing, Andrew Womble, the district attorney for Pasquotank described what was captured in the footage.

The shot to the back of his head was fatal, the family attorneys said at a Tuesday morning news conference outside the public safety building downtown in Elizabeth City. The finding bolsters the claim that Brown was "executed", the family said.

"He got executed", Brown's son Khalil Ferebee said Monday.
